The department’s/agency’s statement

When the Secretariat has received your statement a copy will be sent to your former department/agency for their response. They will also have to submit their statement to the Secretariat within a given deadline.

The department’s/agency’s statement will contain all the facts which it thinks are relevant, and explain the reason for dismissing you. It will also contain copies of relevant documents.

At the same time as the department/agency are asked to submit their statement you will also be informed that the request has been made and given a date for your hearing. Copies of the Department’s/Agency’s statement will be sent by the Secretariat to you and your representative and you will have the Department’s/Agency’s statement for a minimum of three weeks prior to the date of your hearing.

If you want the department/agency to provide any other documents you should ask the Secretariat who will, in discussion with the Board, decide if they are relevant. If they consider that they are, the department/agency will be asked to produce them, and unless there is some special consideration of confidentiality they will be copied to you.

Extra documentation (either your response to the Department’s/Agency’s statement of case or additional papers that you wish the Board to consider) can be submitted up to 10 working days before the hearing but it essential that anything you wish the Board to consider is submitted in writing prior to the hearing. It is preferable that extra documents are received prior to that deadline to ensure they can be circulated to all parties and considered in a timely fashion. Any papers that are forwarded on the 10th working day before the hearing must arrive no later than mid-day to allow time for them to be circulated. Anything received after midday will be not be considered as having been received on time and, irrespective of the content, will not be submitted to the Board. New statements of case or further grounds of appeal will not be accepted. The Board may decide to admit further documentation from you if the department/agency submit papers on or close to the 10th working day and accepts that a response from you is necessary before the hearing. Otherwise you will be able to deal with this as part of your oral statement to the Board.
